Last week, the Montana Supreme Court held that a house held in an irrevocable trust was not a countable asset for purposes of Medicaid eligibility.  The Court reversed both an administrative law judge and a district court.  The Court adopted an argument advanced by the Amici National Academy of Elder Law Attorneys, Inc., and Montana Elder Law, Inc., which were represented by Tom Singer and Amanda Hunter of Axilon Law.
