Gary Hermann

Gary Hermann, now Of Counsel to the firm, is a successful practicing attorney with nearly 40 years of experience representing clients in civil and commercial litigation. This has included extensive involvement in a wide range of insurance-related litigation, including insurance defense, insurance coverage litigation, and bad faith litigation. He also has extensive experience in products liability, toxic torts, construction litigation, trucking litigation, and drug and medical device defense. Gary also has represented clients regarding business organizations, contracts and other transactional matters.

IN THE PROFESSION

Gary has received Martindale-Hubbell’s “AV” rating for legal ability and ethics, the highest possible rating awarded by this nationally recognized, peer-reviewed rating system. When practicing in Ohio, he was selected six times by his peers as one of Ohio’s “Super Lawyers” in civil defense litigation, a designation which is to be given only to the top five percent of lawyers in the State.  In Montana, he has continued to receive recognition for excellence, as indicated by his selection to the 2013, 2014, and 2015 Mountain States Super Lawyers list in the field of “Civil Litigation Defense.”

Gary is an active member of many legal and industry associations, including the Montana Bar Associations (Construction Law Committee), the Federation of Defense and Corporate Counsel (former Vice Chairman, Products Liability Section), the Defense Research Institute, and ALFA International (Steering Committee-Insurance Law Practice Group).

In the past, Gary has been a regular contributor to industry and legal journals and other publications, writing on a variety of legal topics. While in law school, he was the Associate Editor of the Northwestern University Journal of Criminal Law. Some of his articles include “The Consumer Expectation Test: Application of a Difficult Standard for Determining Defects” (Federation of Insurance and Corporate Counsel Quarterly, Winter, 1991) and “Use of Consent Judgments in Insurance Coverage Disputes” (For the Defense, Defense Research Institute, 1982).

Gary has been a regular speaker before legal and industry groups on such topics as “Conducting Voir Dire in a Medical Products Liability Case,” “Techniques for the Use of a Toxicologist in a Toxic Tort Case,” “The Use of Consent Judgments in Litigation,” and “Case Evaluation Using Actuarial Studies of Jury Verdicts.” He has also served as an adjunct instructor at Hiram College.

IN THE COMMUNITY

Gary has been actively involved in a wide range of volunteer and other activities. He coached youth ice hockey in Ohio for 15 years and currently serves on the Board of the Big Sky Skating and Hockey Association. He is a longtime martial artist, with a 4th degree black belt in Taekwondo, and many years of study in Tai Chi, Xing-Yi, Bagua, and Chi Kung. He taught Taekwondo and martial arts for many years as a senior instructor at the Oriental Martial Arts College in Ohio and as an adjunct instructor at Hiram College. During the past five years, he has taught Tai Chi/Chi Kung in Big Sky, Montana. He previously served on a board at Notre Dame College in Ohio, and has advised various non-profit organizations in Montana.
